1. CASES OF CONTRACT
The subject of this Agreement is the regulation of mutual relations between MOUNTAIN & FOREST TRAVEL d.o.o. travel agency (hereinafter referred to as ORGANIZER) and CLIENT, i.e. the contractor of the travel arrangement/excursion, in the case when the contractor of the arrangement/excursion concludes this contract for the benefit of a third party as a client (hereinafter referred to as CLIENT).
The contract is considered binding after it has been signed by the ORGANIZER and the CLIENT, and after the CLIENT has paid the price of the package/excursion in full. If the CLIENT is not able to sign the contract in person, the contract produces legal effects only when the ORGANIZER receives the entire agreed amount of the price of the package/excursion. When concluding the contract, the CLIENT is obliged to provide personal data and timely provide all the documentation necessary for the organization of the arrangement/excursion.
2. RESERVATION AND PAYMENT
In order to secure its place in the activities of the ORGANIZER, the CLIENT can register through the website, and after the submitted offer pays a deposit. The deposit is paid in full, or as stated in the specified offer of a particular arrangement/excursion. If payment in instalments is indicated, the rest up to the total price is paid no later than 15 days before the start of the selected arrangement/excursion. If the CLIENT does not fulfill his/her obligation no later than 15 days before departure for the excursion or trip, it will be considered that he/she has canceled the reservation without the possibility of refunding the deposit paid.
3. PRICES
The prices of the activities of the package/excursion are based on the contract with our partners and do not have to correspond to the prices published on the spot, and any price difference cannot be the subject of a complaint.
The ORGANIZER may request an increase in the agreed price of the selected arrangement/excursion, no later than 21 days before departure if, after the conclusion of the contract, there has been a change in exchange rates or an increase in transport costs, including fuel costs or an increase in fees, of which he did not know or could not have known. In this case, the price of the selected activity will increase reciprocally by increasing the price of the calculative elements on the basis of which the price is formed. CLIENT agrees to accept contract price increase up to 10%. If there is an increase in the agreed price in the amount of more than 10%, the CLIENT has the right to withdraw from the selected activity, but is obliged to notify the ORGANIZER in writing within 2 working days of receiving the notification. In case of cancellation of the selected arrangement/excursion, the CLIENT is not entitled to compensation. If the CLIENT does not deliver his/her cancellation to the ORGANIZER in writing and within the stated deadline, he/she is deemed to agree to the price change.
4. CANCELLATION OF INVESTMENTS/ EXPERIENCES FROM THE CLIENT'S PARTY
If the CLIENT cancels the paid multi-day trip, the ORGANIZER retains from the total price:
- 61 days and more before departure, 0% the price of the arrangement;
- 60-46 days before departure, 25% the price of the arrangement;
- 45-31 days before departure, 50% the price of the arrangement;
- 30-16 days before departure, 75% the price of the arrangement;
- 15-00 days before departure, 100% the price of the arrangement;
If the CLIENT has chosen to pay in installments, the paid installments are not refunded.
If the CLIENT cancels the paid one-day excursion, the ORGANIZER retains from the total price:
- 04 and more days before departure, 30% Excursion prices
- 03-00 days before departure 100% Excursion prices
If the CLIENT cancels the paid one-day excursion with additional facilities, (horse riding, rafting, cycling) the ORGANIZER retains from the total price:
- 61 days and more before departure, 0% Excursion prices
- 60-46 days before departure, 25% Excursion prices
- 45-31 days before departure, 50% Excursion prices
- 30-16 days before departure, 75% Excursion prices
- 15-00 days before departure, 100% Excursion prices
If the CLIENT has chosen to pay in installments, the paid installments are not refunded.
5. CANCELLATION FROM SIDE MOUNTAIN & FOREST TRAVEL d.o.o. travel agency, prior to travel
ORGANIZER reserves the right to cancel the package/excursion. If we are forced to cancel the arrangement/excursion before the trip, we will try to find an adequate replacement or if not, we will refund the paid amount in full for the selected arrangement/excursion. The ORGANIZER cannot be held liable for any other loss incurred due to the cancellation of the planned activity.
The cancellation of the planned activity may occur due to:
- Unfavourable weather conditions or objective circumstances in general
- No payment by the client
- If clients have less time available than agreed, as this significantly loses on the quality of the arrangement/excursion.
- Disease or accident of the organizer
- Insufficient number of reported persons
- Emergency situations
- ORGANIZER reserves the right to cancel the arrangement/excursion to anyone without explanation
6. ACTIVITY AMENDMENTS
Given the nature of the activities offered, ORGANIZER reserves the right to change the arrangements/excursions, accommodation and travel routes at any time. Although it is unlikely that everything changes, it is usually minor changes. Should there be major changes and additions, the CLIENT will be informed before making any changes. The ORGANIZER will always strive to provide an activity according to the planned programme. Possible reasons for the change are:
- weather conditions, natural disasters
- traffic conditions: at sea, on earth, in the air
- emergency situations, war, civil unrest, terrorism, epidemics
- force majeure
If, for the above reasons, the arrangement/excursion is terminated, the ORGANIZER cannot be held responsible for all the costs incurred by the CLIENT.
7. RESPONSIBILITY AND PERSONAL SAFETY
The ORGANIZER employs only qualified staff. All employees have received professional training and are licensed as tourist escorts, approved by the Ministry of Tourism. The ORGANIZER emphasizes that given the nature of the activities it offers, accidents are possible, and the CLIENT must be aware of the risks.
ORGANIZER cannot be held responsible for circumstances beyond its control, and participation in the activities is a CLIENT's risk. The CLIENT is obliged to bring the basic personal equipment, as indicated on the ORGANIZER's website in the category "What to bring". Depending on the activity that the CLIENT chooses, the ORGANIZER will send the list of equipment that the CLIENT must have with them in a timely manner. All equipment will be checked before the tour, and the ORGANIZER or tour escorts have the right to refuse the participation of the CLIENT on the tour if they do not have basic personal equipment and without refund. The safety of the CLIENT comes first, and the decision of the tourist companion is final. The CLIENT can at any time freely contact the ORGANIZER regarding the equipment, and we will be pleased to provide all the necessary information.
8. DESCRIPTION
The client is obliged to take care of his or her belongings by taking them on the bus, van, boat, plane, hotel, and he or she is obliged to take them with him or her every time he or she leaves the same. Otherwise, the CLIENT is responsible for the theft, loss or damage of the items left in the above mentioned places.
9. ACCOMMODATION IN ROOMS/APARTMENTS
If the CLIENT has not explicitly contracted a room/apartment with some special comfort, orientation or floor, he will accept any officially registered room/apartment in the facility in question. The ORGANIZER has the right to change the contracted accommodation only by accommodation in the same or higher category, and at the expense of the ORGANIZER, as well as the right to change the schedule of excursions per day.
10. HEALTH PROPIES
The client is obliged to inform the ORGANIZER about all the facts regarding his health, habits, etc., which could endanger the travel (if for health and other reasons he is looking for a certain type of food, suffers from chronic diseases, allergies, etc.). The ORGANIZER will send a health questionnaire prior to the arrangement/excursion and the CLIENT will forward it to the ORGANIZER as soon as possible. The data entered by the CLIENT in the questionnaire are secret and are used exclusively for informing the tourist companion.
The CLIENT confirms that he is in good physical and mental condition and that he is able to participate in selected activities. CLIENT should be aware that most activities require effort. If the CLIENT is under the age of 18, the ORGANIZER will seek the consent of the parents in order to allow the minor to participate in the selected activities.
11. RESPONSIBILITY SOLUTION
The client is guided by a licensed tour escort, and agrees that his decision is final, and will guide him in all situations during the activity.
ORGANIZER reserves the right to refuse participation of CLIENT with the rest of the group, when performing activities. The reasons may be: illegal actions, irresponsible behavior that threatens the entire group, guide or any other client. In such a case, the ORGANIZER will not accept any further liability, and will not be liable for the costs of the CLIENT that may arise when returning to the place of residence. Also, in this case, the CLIENT does not have the right to refund the paid amount for the arrangement/excursion.
If the CLIENT considers that the service is unsatisfactory, he has the right to file a complaint with the ORGANIZER. Complaints must be submitted in writing within 5 days after the service has been performed. During the 5-day deadline, it is considered that the CLIENT is satisfied with the service performed. We emphasize that it is in the interest of CLIENTs to act in good faith and express their will to resolve complaints during the trip and to address their complaint to the service provider on the spot. Each CLIENT shall file a complaint separately. The ORGANIZER will not consider group objections. The ORGANIZER is obliged to respond to the complaint within 15 days of receipt of the complaint, in the manner in which the complaint was received (by e-mail or mail).
The ORGANIZER will deal only with those complaints for which the CLIENT provides evidence that he submitted a written complaint to the service provider on the spot and that the cause could not be eliminated on the spot. If due to the fault of the ORGANIZER there has been a failure to comply with the program or part of the services, the CLIENT has the right to compensation in the amount of the actual value of unused services and cannot include the already used services as well as the entire amount of the arrangement / excursion. Until the ORGANIZER decides on the CLIENT's objection, the CLIENT disclaims the mediation of any other person, judicial institution or the provision of information to the media.
12. RISICS
External activities carry risks. As a responsible provider of external activities, the ORGANIZER highlights the potential risks to the CLIENT while participating in the selected activities.
The ORGANIZER and its staff take the health and safety of the CLIENT very seriously, but it is not possible to completely eliminate the risk in such activities. We will list some of the dangers that may occur when performing the selected activity. The CLIENT should be aware that accidents in such circumstances can lead to serious injuries, and in exceptional cases can also have a fatal outcome:
Physical and mental effort
- Adverse weather conditions (wind, rain, snow, cold, heat, storm surges, lightning, etc.)
- Irregular, slippery and dangerous surfaces (stone, rockfall, ice, grass, scissors, pits, etc.)
- Road transport, road accidents
The goals of individual activities (top, specific tours, time frame, etc.) will not be possible to achieve during bad weather conditions. The ORGANIZER will not be responsible for such circumstances on the ground. Nature can be unpredictable, and the CLIENT confirms that he understands and accepts the above. The safety of the client and the group is ahead of all the goals of the selected arrangement/excursion.
The decisions of the guide on the choice of the tour, as well as the decisions related to the continuation of the activity and the participation of the CLIENT in the activity are final. It is possible that due to the rapid change of weather conditions, the travel companion changes the route in the short term. A CLIENT should be aware that sudden changes in weather in nature are possible at any time of the year. The ORGANIZER will make every effort to ensure that the arrangement/excursion takes place according to the planned programme when possible. However, this can never be guaranteed.
13. IMPOSSIBLE OBJECTIVES
During the activity on the arrangement/excursion, unforeseeable circumstances are possible. State of emergency, civil unrest, war, terrorism, traffic accidents, natural disasters, weather conditions, epidemics. In these cases, it is necessary to change the agreed itinerary or abandon the excursions/arrangements with the aim of returning home or arriving at a safe place. The ORGANIZER cannot be held responsible for these situations, and is in no way responsible for any personal expenses incurred by the CLIENT. Possible costs, the CLIENT bears the costs himself. Possible costs of the CLIENT in unforeseeable circumstances:
- Transport (land, water, air)
- overnight stay or stay in accommodation facilities
- food
- Equipment
- all personal expenses
Due to these unforeseeable circumstances, the ORGANIZER is not obliged to reimburse the CLIENT for the unused number of days on the arrangement/excursion.
14. PROTECTION OF PERSONAL DATA
The CLIENT provides personal data voluntarily. The personal data of the CLIENT is required in the process of realization of the agreed arrangement/excursion and will be used for further communication. We take the protection of your data very seriously. We will treat your personal data in accordance with the provisions of the Personal Data Protection Act. We will use them solely to contact you regarding the program described on this website. We expressly declare that we will not forward personal data to third parties. The exception to the provision of personal data to third parties refers to the contracting of travel insurance policies, or if the CLIENT concludes an insurance policy, then his personal data will be forwarded to the insurance company. The personal data of the CLIENT will be kept in the database. The CLIENT agrees that his/her personal data may be used for the purpose of realization of the agreed arrangement/excursion.
15. SUPPORTING THE CONTRACT
Signing of the contract is done personally or electronically, through the website. In case of electronic signature of the contract, the CLIENT and ORGANIZER agree that it is enough to click on the button "I agree to the General Terms and Conditions"
16. INFORMATION
Notifications that the CLIENT receives at the registration places do not oblige the organizer to a greater extent than the notifications and information stated in the travel program itself.
17. FINAL PROVISIONS
General terms and conditions and instructions on the arrangement/excursion are an integral part of the contract concluded by the CLIENT with the ORGANIZER. The Parties undertake to settle any dispute by mutual agreement. If this is not possible, in the event of a dispute, the court in Zagreb has jurisdiction, and Croatian law applies.
